LIGHTING RETROFIT Status: Presented by: Action Byron Woods Dean, Facilities Issue The District is requesting that the Board of Trustees award Clear Blue Energy Corp of San Diego, CA the bid for the Prop. 39 Year 5 L.E.D. Lighting Retrofit project. Background In November 2012, Proposition 39, the Clean Energy Jobs Act of 2012, was voted into law. This initiative provides the California Community Colleges and K-12 systems five (5) annual budget allocations to be used to develop energy savings and create energy related jobs. For , the District received $332,349 and was granted approval in February 2018 to proceed with the fifth year of energy efficiency improvement projects. The District has elected to pursue two separate projects: 1) Sequoia Building HVAC Upgrades and 2) LED Lighting Retrofit. Funds allocated to the Year 5 scope of work are required to be expended by the District by June 30, In addition to the Year 5 funds, an additional $156k is being carried forward from Year 4 due to lower than expected bid results. The total funds available for both Year 5 projects is $488,927. The Sequoia Building HVAC Upgrades project was awarded at the April 2018 board meeting total project cost is approximately $177k. This provides an estimated $312k available for the LED Lighting Retrofit project. The Prop. 39 Year 5 L.E.D. Lighting Retrofit project entails an L.E.D. lighting retrofit of interior and exterior lighting upgrades on the Visalia, Hanford and Tulare campuses. The base bid scope of work includes interior upgrades at the Ponderosa lecture hall and Hanford Education classrooms, as well as exterior upgrades at the Visalia track and field, pool complex, tennis courts and Tulare parking lot, walkways and buildings. TETER Architects & Engineers has been contracted by the District to prepare the bid documents and provide construction oversight for this project and will verify that new lighting conditions meet or exceed the existing lighting levels in all locations in the scope of work. This project is scheduled to be completed June through August A bid opening was conducted on March 27, Four (4) bids were received and

2 opened for this project, all of which exceeded the maximum allowable construction budget for this project ($285k). The District elected to reject all bids due to budgetary limitations. The scope of work was reduced, removing the Tulare exterior building lighting from the project, and the project was reissued to bidders. On May 3, 2018, four (4) bids were received and opened for this project. The lowest responsive bidder was Clear Blue Energy Corp of San Diego, CA with a Base Bid of $104, The Bid Tabulation sheet and Bid Proposal are attached for reference. The total bid amount for this project, including the Base Bid plus all Alternate Bid Items, is $303, Due to the significant range in bid amounts, the Dean of Facilities contacted three of the four bidders to discuss the results. It was determined that the two low bidders proposed a lighting manufacturer substitution request during bidding as permitted in the project specifications the request was approved by TETER A&E and information was issued to all bidders during the bidding period via Addendum No. 1. All bidders acknowledged receipt of Addendum No. 1 on their bid proposal forms, however, the two higher bidders elected not to get pricing from those manufacturers. The Dean of Facilities has communicated directly with Jim Kelly, COO of Clear Blue Energy Corp, and his supporting staff to confirm that their bid is valid and that they clearly understand the entire scope of work, including scheduling restrictions. No items of concern were presented in these and phone conversations. In addition, the bonding company was validated and expressed no concerns with the contractor s work history. To further reinforce the above information, the Dean of Facilities also reached out to Davis Joint Unified School District DJUSD experienced a similar situation with Clear Blue Energy Corp s bid being significantly lower than others. That project is in the project closeout phase and the district has experienced no complains related to the contractor s performance. Recommended Action It is recommended that the Board of Trustees award the Base Bid and Alternate Bid Items #1, #2 and #4 in the amount of $282,248.38, for the Prop. 39 Year 5 L.E.D. Lighting Retrofit project to Clear Blue Energy Corp of San Diego, CA.
