4 FDOT DESIGN-BUILD PUSH BUTTON Contract -- History Starting in Year 2004 questions from District Traffic Operations concerning developing a new type of contract that would significantly reduce the amount of time it took to get a project from concept to concrete. Florida DOT already utilizes two (2) innovative types of contracts that provide some time-savings over the traditional Design-Bid-Build methodology. But, those two (2) innovative types of contracts Design-Build and Push-Button still had their limitations. Therefore, during a moment of inspiration, we reasoned why not try to combine those two (2) contracting strategies into a single contract? Traffic Operations Design-Build Push-Button concept was born! (Similar to FHWA TOPICS ) THEN, OUR NEXT CHALLENGE WAS TO SELL THE PLAN FDOT DBPB Evaluation 4
5 FDOT DESIGN-BUILD PUSH BUTTON Contract History (Cont.) On February 11, 2004, District Seven began to correspond with the Central office about our proposal of combining the design-build contracting methodology with the push-button contracting methodology to marry the benefits of both of those contracting strategies into a single contract using both State funds and Federal safety funds. In September, 2007, Central office agreed to allow District Seven to proceed with a pilot program to test-fly this one-of-a-kind and totally unique contracting concept. While the District began developing the RFP for such a combined contract, District Seven worked with FHWA FL Division to gain approval to include federal safety money under this unique combined contract on June 30, With FHWA s concurrence, District moved forward with the concept by conducting an informational meeting with the consultant community and the contractor industry. And, after receiving input from that forum, we completed the RFP and advertised the contract on March 24, District shortlisted three teams, evaluated their technical proposals, opened their price proposals, calculated the resulting adjusted-scores, and finally posted our contract execution on December 17,

FDOT Push Button Contract is similar to the NYDOT Job Order Contracting (JOC) multiple tasks see FHWA 5/24/11 webinar NYDOT JOC can only handle Preventive Maintenance tasks using federal funds FDOT can only use State fund for Push Button construction contract multiple tasks! Current FDOT construction approach for federal safety funded projects Design/Bid/Build or Design/Build one project per contract! DBPB contract combines the beauty of Design-Build & Push Button contracts -- to be able to use federal safety funds to issue multiple safety projects during the contract period (two or three years)! 9
10 FDOT DESIGN-BUILD PUSH BUTTON - Contract Process Develop the Request for Proposal (RFP) by Traffic Operations office. Communicate with Contract, Design & Construction offices. Prepare the Contract package by Professional Service office. Obtain approval from Legal office & FHWA Division office. Allocate State and/or Federal fund for the Contract. Will need to decide the length of the contract (3 contract years in FL now) & Stipends (not allow in FL now). Develop the initial projects in the 1 st contract task for short listed teams. Advertise the contract. Select the short listed teams (3) to design those initial projects. Rank & Select the winning team using the adjusted scores approach. Execute the contract it is a 9+ months process!!! 10

12 FDOT DESIGN-BUILD PUSH BUTTON - Task Process Conduct the thorough Feasibility (all funds) & Justification (Federal Safety Funds) Study - includes National Environmental Policy Act (NEPA) requirements. Generate Task Scopes with maximum task time and cost. Conduct the Task Scopes Review Coordination! Send Task Scopes with all supporting studies to FHWA for approval. Allocate the approved State or Federal fund for each DBPB task. District Construction office sends the task(s) Notice to Proceed (NTP) to the DBPB Prime firm. DBPB team starts to work on the task! Task time period is counted from NTP to end of the construction. Use SharePoint technology and weekly progress meetings to share the DBPB Plans & task Information Communication is the Key for Success! 12

Design & Survey Fee % for the traditional design-bid-build projects shown in the Florida DOT system depends on the size of the projects varies from 8% (mega $100+ million projects) to 150+% (small operational projects). DBPB projects are usually in the small operational project (30% to 150+%) category. Construction Engineering Inspection Fee % in the DBPB contract funded and conducted by FDOT average 9%. Construction Engineering Inspection Fee % for the traditional design-bid-build projects shown in the Florida DOT system average 10% - 15%. 24 FDOT DESIGN-BUILD PUSH BUTTON Cons Administration Issues -- requires a higher level and constant communication between all offices to streamline process. Tasks need to have good feasibility study & clear project scopes. Technology is good. However, if system breaks, time lost! NEPA is needed even for state funded projects. Traffic Operations DBPB contract is designed to address traffic operational or safety issues, not roadway improvements higher unit price for roadway items. Limited pay items. There are issues to be resolved when adding pay items. Potential backlog due to numerous tasks need to plan work force well. Limited staff to review multiple tasks concurrently. Difficult to address safety along local roadways if locals are not stepping up. 24
