32 QP Owner QP C As the qualified person, I certify that: * A phase one environmental site assessment of the RSC property, which includes the evaluation of the information gathered from a records review, site reconnaissance, interviews, a report and any updates required, has been conducted in accordance with the regulation by or under the supervision of a qualified person as required by the regulation. A phase two environmental site assessment of the RSC property, which includes the evaluation of the information gathered from planning and conducting a site investigation, a report, and any updates required, has been conducted in accordance with the regulation by or under the supervision of a qualified person as required by the regulation. The information represents the site conditions at the sampling points at the time of sampling only and the conditions between and beyond the sampling points may vary. As of 2013/04/01, in my opinion, based on the phase one environmental site assessment and the phase two environmental site assessment, and any confirmatory sampling, there is no evidence of any contaminants in the soil, ground water or sediment on, in or under the RSC property that would interfere with the type of property use to which the RSC property will be put, as specified in the RSC. Ground water sampling has been conducted in accordance with the regulation by or under the supervision of a qualified person as required by the regulation. As of 2013/04/01, in my opinion, based on the phase one and phase two environmental site assessments and any confirmatory sampling, the RSC property meets the applicable full depth generic site condition standards prescribed by section 36 of the regulation for all contaminants prescribed by the regulation in relation to the type of property use for which this RSC is filed, except for those contaminants (if any) specified in this RSC at Table 2, Maximum Compared to Standards Specified in a Risk Assessment. As of 2013/04/01, the maximum known concentration of each contaminant in soil, sediment and ground water at the RSC property for which sampling and analysis has been performed is specified in this RSC at Table 1, Maximum Compared to Applicable Site Condition Standards. I am a qualified person and have the qualifications required by section 5 of the regulation. I have in place an insurance policy that satisfies the requirements of section 7 of the regulation. The Phase Two Conceptual Site Model consists of this text and attached drawings. Section i. A description and assessment of, A. areas where potentially contaminating activities (PCAs) has occurred, B. areas of potential environmental concern (APECs), and Phase Two Property There are two PCAs on the Phase Two Property and four PCAs of note within the Phase One Study Area. Please refer to Drawing 4. There are two APECs where PCAs (on-site and off-site) may have affected the soil and/or ground water at the subject site: APEC A (Entire Phase Two Property): Importation of Fill Materials; fill material of unknown quality. 47 Ontario Regulation 153/04 Phase Two Conceptual Site Model (CSM) C. any subsurface structures and utilities on, in or under the Phase Two Property that may affect contaminant distribution and transport, Section ii. a description of and, as appropriate, figures illustrating, the physical setting of the Phase Two Property and any areas under it including, A. stratigraphy from ground surface to the deepest aquifer or aquitard investigated, B. hydrogeological characteristics, including aquifers, aquitards and, in each hydrostratigraphic unit where one or more contaminants is present at concentrations above the applicable site condition standards, lateral and vertical gradients, No subsurface structures were identified on the Phase Two Property. Also, no subsurface utilities were identified on, in, or under the Phase Two Property. Please refer to Drawing 4A. The subject property is a 3.97-hectare (9.81- acre), rectangular shaped, parcel of vacant land located on the south side of Major Mackenzie Drive East, in Markham, Ontario. Please refer to Drawing 4A. The observed soil stratigraphy comprised topsoil and clayey silt to silty clay fill material from ground surface to a depth of 1.4 m overlying a silty sand till stratum which ranged from 0.3 to 6.5 m and a sandy silt till stratum from 1.4 to 6.2 m. Bedrock was not encountered. Please refer to Cross- Section A-A, Cross-Section B-B, and Drawing 4A. The results of the ground water monitoring indicated that the primary near surface water table resides within the sandy silt/silty sand till layer. No evidence of impact was noted in the ground water, therefore only the shallow aquifer warranted investigation. Ground water flow in the area is generally inferred in a southeastward direction with components to the southwest, possibly due to the influence of ponded surface water located near the northeast side of the Phase Two Property. Please refer to Figure No exceedences above applicable standards were identified in the soil and ground water samples collected across the Phase Two Property for the following parameters

48 Ontario Regulation 153/04 Phase Two Conceptual Site Model (CSM) tested: Petroleum Hydrocarbons (PHCs), Metals, Volatile Organic Compounds (VOCs) and Organochlorine pesticides (OCs). The average lateral hydraulic gradient is m/m. Based on grain size analysis testing, the hydraulic conductivity of the silty sand is estimated to be on the order of 10-6 mm/s. C. approximate depth to bedrock, Not encountered within the maximum exploration depth of 6.5 m below grade in our Phase Two investigation. Based on historical water well records, bedrock is estimated to be at depths greater than 40 m below grade. D. approximate depth to water table, Static ground water levels were observed at depths ranging from 0.30 to 2.66 m below ground surface. E. any respect in which section 41 or 43.1 None. of the regulation applies to the property, F. areas where soil has been brought from another property and placed on, in or under the Phase Two Property, and G. approximate locations, if known, of any proposed buildings and other structures. Section iii. 51 Figure 9.2.3: Ground Water Elevations Ontario Regulation 153/04 Phase Two Conceptual Site Model (CSM) This Conceptual Site Model is based on the following information: Illustrates the inferred ground water flow direction based on measured ground surface and ground water elevations within the Phase Two Property, as well as the adjacent property to the west which was investigated concurrently. The subject property is a 3.97-hectare (9.81-acre), rectangular shaped, parcel of vacant land located on the south side of Major Mackenzie Drive East, in Markham, Ontario. The subject property is contemplated for residential development. Historically, the Phase Two Property comprised agricultural land associated with the farmstead located at 5601 Major Mackenzie Drive East. Agricultural activities subsequently ceased in 1995 and the property has since remained tenanted for residential and parking uses associated with 5601 Major Mackenzie Drive East. No areas of natural significance were observed on the subject property or in the Phase One Study Area. However, one water body of interest, a tributary of the Berczy Creek is located within 5 to 10 m east of the Phase Two Property, which flows south into Rouge River before emptying into Lake Ontario. The areas of potential environmental concern (APECs) on the Phase Two Property are shown in Drawing 4 and are as follows: Location of APEC Entire Phase Two Property West Part of the Phase Two Property Rationale Importation of Fill Materials; fill material of unknown quality. 52 Ontario Regulation 153/04 Phase Two Conceptual Site Model (CSM) Gasoline and Associated Products; offsite basement heating oil AST located at 5616 Major Mackenzie Drive East. The Phase Two ESA Sampling and Analysis Plan were developed to investigate the APECs identified in the Phase Two ESA CSM. A drilling program was conducted to investigate soil and ground water in the areas of the aforementioned APECs. The Phase Two Property was assessed using the 2011 MOE Table 8 Standards for residential land uses in a potable ground water condition with coarse-textured soils from the MOE document Soil, Ground Water and Sediment Standards for Use Under Part XV.1 of the 2011 EPA. Chemical analyses of soil and groundwater samples were conducted by Testmark Laboratories, of Mississauga, Ontario. A total of four boreholes (BH101, BH102, BH103 and BH104) were advanced within the Phase Two Property. Three of the boreholes were completed as ground water monitoring wells in order to permit the collection of ground water samples. Soil and ground water samples were selected for submission of chemical analysis of identified contaminants of concern, which included PHCs, Metals, VOCs and OCs. The stratigraphy from the ground surface to the aquifer investigated in the Phase Two Property included topsoil and clayey silt to silty clay fill material (0 to 1.4 m). The native soil generally consisted of sandy silt till (0.3 to 6.5 m) and silty sand till (1.4 to 6.2 m). Bedrock was not encountered within the maximum depth of exploration. The shallow ground water table was encountered below the Phase Two Property at depths ranging from 0.30 to 2.66 m below ground surface (geodetic elevations of to m). Based on the static groundwater elevations, the shallow ground water in the area is generally inferred in a southeastward direction with components to the southwest, possibly due to the influence of ponded surface water located near the northeast side of the Phase Two Property. The soil and ground water samples were examined in the field for lithology as well as for aesthetic evidence of impacts (i.e. debris, staining and odours). No elevated soil vapour readings were observed upon field screening of the soil samples using a portable hydrocarbon vapour surveyor. No foreign odours or evidence of hydrocarbon staining was noted in any of the soil and ground water samples.

53 Ontario Regulation 153/04 Phase Two Conceptual Site Model (CSM) All soil and ground water samples collected and analyzed for PHCs, Metals, VOCs and OCs within the Phase Two Property met the applicable 2011 MOE Table 8 Standards for residential land uses, and therefore no appreciable impacts to the subsurface are inferred at the Phase Two Property. Consequently, no further assessment or remedial actions are required at this property for the proposed residential redevelopment.
