16 D Qualified person s statements and certifications As the qualified person, I certify that: A phase one environmental site assessment of the record of site condition property, which includes the evaluation of the information gathered from a records review, site reconnaissance, interviews, a report and any updates required, has been conducted in accordance with the regulation by or under the supervision of a qualified person as required by the regulation. A phase two environmental site assessment of the record of site condition property, which includes the evaluation of the information gathered from planning and conducting a site investigation, a report, and any updates required, has been conducted in accordance with the regulation by or under the supervision of a qualified person as required by the regulation. The information represents the site conditions at the sampling points at the time of sampling only and the conditions between and beyond the sampling points may vary. As of 2015/06/19, in my opinion, based on the phase one environmental site assessment and the phase two environmental site assessment, and any confirmatory sampling, there is no evidence of any contaminants in the soil, ground water or sediment on, in or under the record of site condition property that would interfere with the type of property use to which the record of site condition property will be put, as specified in the record of site condition. Ground water sampling has been conducted in accordance with the regulation by or under the supervision of a qualified person as required by the regulation. I have, within the six months immediately before the submission of this record of site condition, given written notice of intention to apply non-potable ground water site condition standards to the clerk of the local municipality in which the property is located and the clerk of any upper-tier municipality in which the property is located. As of 2015/06/19, in my opinion, based on the phase one and phase two environmental site assessments and any confirmatory sampling, the record of site condition property meets the applicable full depth generic site condition standards prescribed by section 37 of the regulation for all contaminants prescribed by the regulation in relation to the type of property use for which this record of site condition is filed, except for those contaminants (if any) specified in this record of site condition at Table 2, maximum contaminant concentrations compared to standards specified in a risk assessment. As of 2015/06/19, the maximum known concentration of each contaminant in soil, sediment and ground water at the record of site condition property for which sampling and analysis has been performed is specified in this record of site condition at Table 1, maximum contaminant concentrations compared to applicable full depth generic site condition standards. I am a qualified person and have the qualifications required by section 5 of the regulation. I have in place an insurance policy that satisfies the requirements of section 7 of the regulation. I acknowledge that the record of site condition will be submitted for filing in the Environmental Site Registry, that records of site condition that are filed in the Registry are available for examination by the public and that the Registry contains a notice advising users of the Registry who have dealings with any property to consider conducting their own due diligence with respect to the environmental condition of the property, in addition to reviewing information in the Registry. The opinions expressed in this record of site condition are engineering or scientific opinions made in accordance with generally accepted principles and practices as recognized by members of the environmental engineering or science profession or discipline practising at the same time and in the same or similar location. I do not hold and have not held and my employer PATERSON GROUP INC. does not hold and has not held a direct or indirect interest in the record of site condition property or any property which includes the record of site condition property and was the subject of a phase one or environmental site assessment or risk assessment upon which this record of site condition is based. This narrative is to be read in conjunction with the following drawings: Drawing PE2905-1R Site Plan Drawing PE2905-3R Surrounding Land Use Drawing PE Test Hole Location Plan Drawing PE Groundwater Contour Plan Drawing PE Cross-Section A-A' Site Description The RSC Property is located at the southwest corner of Wellington Street West and Rosemount Avenue, in the City of Ottawa, Ontario. At the time of the first involvement by Paterson, the RSC Property consisted of a paved asphalt parking area, a vacant institutional building, and grass-covered open space. At the time of this application, the RSC Property is under development with a residential condominium development which incorporates the existing institutional building. Soldier piles and lagging have been constructed along Rosemount Avenue and Wellington Street West, and soil and bedrock have been excavated to allow for the construction of two (2) levels of underground parking. The majority of soil has been removed from the subject site for development purpose. Prior to Paterson's involvement with the subject site, Pinchin Environmental Ltd. (Pinchin) had completed a Phase I and Phase II ESA for the subject site. These reports were available for review by Paterson. The Phase I ESA identified the historical presence of a retail fuel outlet on the northeast corner of the subject site. Boreholes were drilled and monitoring wells were installed by Pinchin to assess the potential for contamination from these activities. All soil samples from the Pinchin investigation were in compliance with the selected standards, although Pinchin's monitoring wells were installed in overburden above the long-term water table and groundwater samples could not be obtained. patersongroup

48 Mr. Simon Taggart Page 2 File: PE2905-MEMO.01 CSM In February 2013, Paterson completed a supplemental Phase II ESA for the subject site in conjunction with a geotechnical investigation in support of the proposed development. Soil and groundwater samples were submitted for laboratory analysis and were found to be in compliance with the current MOECC Table 3 residential standards for coarsegrained soils. In November 2013, Paterson completed an updated Phase I ESA for the subject site. This Phase I ESA was completed in accordance with the requirements of O.Reg. 153/04 (as amended). The 2013 Paterson Phase I ESA identified the presence of the retail fuel outlet on the northeast corner of the subject site as well as the presence of fill material of unknown quality as Areas of Potential Environmental Concern with respect to the site. The quality of the fill material was considered to have been adequately assessed by the above-noted subsurface investigations by Paterson and Pinchin. Beginning in January 2015, excavation of soils and bedrock at the subject site was commenced, for the purpose of providing underground parking for a residential development under construction at the subject site. It is noted that excavation of site soils and bedrock was undertaken for grading/construction purposes, not for remedial purposes, and as above, soil at the subject site was in compliance with the selected MOECC Table 3 standards. Although groundwater samples collected during the 2013 Paterson Phase II ESA were in compliance with selected MOECC Table 3 standards, it was noted that insufficient monitoring wells were present on-site for groundwater triangulation in support of a Record of Site Condition application, as per the requirements of O.Reg. 153/04 as amended. As such, following the excavation of soil and bedrock at the subject site to final depth, Paterson completed a Phase II ESA for the subject site that included the drilling of four (4) boreholes and the installation of four (4) monitoring wells in the base of the excavation in the vicinity of the former retail fuel outlet. All results from Paterson's 2015 Phase II ESA were in compliance with MOECC Table 3 standards. Potentially Contaminating Activities and Areas of Potential Environmental Concern The Phase I ESAs completed by Pinchin and Paterson identified several Potentially Contaminating Activities at the RSC Property and on adjacent properties. Two (2) onsite PCAs were identified on the RSC Property: Historical presence of retail fuel outlet on the subject site (Item 28, Column A, Table 2, O.Reg. 153/04 - Gasoline and Associated Products Storage in Fixed Tanks ); patersongroup

49 Mr. Simon Taggart Page 3 File: PE2905-MEMO.01 CSM Presence of fill material of unknown quality identified by subsurface investigations on the subject site (Item 30, Column A, Table 2, O.Reg. 153/04 - "Importation of Fill Material of Unknown Quality"). These PCAs are considered to represent APECs with respect to the RSC Property. Additional PCAs identified within the Phase I study area are not considered to represent APECs with respect to the RSC Property, given their separation distance and/or downgradient or crossgradient orientation with respect to the RSC Property. Contaminants of Potential Concern and Impacted Media The following Contaminants of Concern were identified with respect to the RSC Property: Volatile Organic Compounds (VOCs) - this suite of parameters includes chlorinated solvents (tetrachloroethylene, trichloroethylene, dichloroethylenes, and vinyl chloride) associated with de-greasing and dry-cleaning processes, as well as benzene, toluene, ethylbenzene, and xylenes (BTEX) associated with gasoline and diesel fuel. These parameters were selected as CPCs for groundwater at the RSC Property based on the historical presence of the retail fuel outlet on the subject site. Petroleum Hydrocarbons, Fractions 1 through 4 (PHCs F1-F4) - this suite of parameters encompasses gasoline (Fraction 1), diesel and fuel oil (Fraction 2), and heavy oils (Fractions 3 and 4). PHCs F1-F4 were selected as CPCs for the RSC Property based on the historical presence of the retail fuel outlet on the subject site. PHCs may be present in the soil matrix, sorbed to soil particles, as well as in free or dissolved phase in the groundwater system. PHCs are generally considered to be LNAPLs light non-aqueous phase liquids, indicating that when present in sufficient concentrations above the solubility limit, they will partition into a separate phase above the water table, due to their lower density. Subsurface Structures and Utilities The subject site is located in a municipally serviced area. The former institutional building is serviced with municipal water, storm, and sanitary sewer services, as well as with electricity and gas. Service trenches are present between Wellington Street West and the institutional building. patersongroup

50 Mr. Simon Taggart Page 4 File: PE2905-MEMO.01 CSM In general, underground service trenches may have the potential to affect contaminant distribution and transport at the subject site by providing preferential pathways for contaminant migration. However, underground service trench elevations were above the observed water table in the vicinity of the RSC Property, and no contaminant sources or were observed on the subject site at the time of Paterson s 2015 Phase II ESA. No visual or olfactory evidence of contamination was encountered during excavation for the redevelopment of the subject site. As such, subsurface utilities are not considered to have affected contaminant transport or distribution at the subject site. All groundwater results from the 2015 Phase II ESA were in compliance with the selected MOECC Table 3 standards. No subsurface structures were observed at the subject site. All pumps, tanks, and piping associated with the former retail fuel outlet at the subject site had been removed before Paterson's involvement with the subject site. No subsurface structures were encountered during excavation for site redevelopment.. Physical Setting Site Stratigraphy The site stratigraphy, from ground surface to the deepest aquifer investigated, prior to excavation, consisted of: Fill material, consisting of sandy gravel to silty clay, varying in thickness from 0.69 to 2.97 m. Groundwater was not encountered in the fill layer. A layer of glacial till, consisting of silty sand, trace gravel, encountered at depths varying from 0.69 to 2.97 m, and varying in thickness from 0.97 to 2.06 m. The glacial till layer was not encountered in the boreholes on the northwest portion of the site. Groundwater was not encountered in this layer. Grey limestone bedrock of the Middle Ordovician Bobcaygeon Formation. Bedrock was encountered at depths ranging from 0.9 to 3.8 m below existing ground surface at the subject site, with at least 2 m of overburden present over the bedrock across the majority of the site. Groundwater was encountered in the bedrock unit at the subject site. The bedrock is interpreted to function as a local aquifer in the vicinity of the subject site. This is the deepest unit investigated. It is noted that all soils and a significant amount of bedrock has been excavated from the northern portion of the subject site. The purpose of this excavation was not site remediation or the removal of contaminated soil, but instead to allow for the construction of an underground parking garage at the subject site. patersongroup

51 Mr. Simon Taggart Page 5 File: PE2905-MEMO.01 CSM Hydrogeological Characteristics Groundwater was encountered in the limestone bedrock unit. This unit is interpreted to function as a local aquifer at the subject site. Water levels were measured at the subject site on June 19, Groundwater was encountered at depths varying from 0.22 to 5.88 m below the base of the excavation. Water levels are shown on Drawing PE The water level at BH3-15 (5.88 m below base of excavation) was inconsistent with the water levels observed in the other monitoring wells at the subject site (between 0.22 and 0.89 m below base of excavation). Given that only two days elapsed between the drilling of the wells and the measurement of water levels, it is our interpretation that the water level in BH3-15 did not have sufficient time to stabilize. BH3-15 was not included in groundwater contour mapping for the subject site. Based on the groundwater elevations from the June 2015 monitoring event, groundwater contour mapping was completed and the horizontal hydraulic gradient for the subject site was calculated. Groundwater flow at the subject site appears to be in a westerly direction. As such, the groundwater monitoring wells installed at the subject site are considered to correctly situated to intercept any potential groundwater contamination resulting from the identified APECs. A hydraulic gradient of approximately 0.04 m/m was calculated. Approximate Depth to Bedrock Bedrock at the subject site was encountered at depths ranging from 0.9 to 3.8 m below ground surface prior to excavation activities for site development, with at least 2 m of overburden present across the majority of the site. Approximate Depth to Water Table The observed depth to water table at the subject site varied between 0.22 m and 5.88 m below the base of the excavation. Excluding the measurement of 5.88 m below the base of the excavation, water levels of 0.2 to 0.9 below the base of the excavation are considered to be more representative. Sections 41 and 43.1 of the Regulation Section 41 of the Regulation (Site Condition Standards, Environmentally Sensitive Areas) does not apply to the subject site, in that there are no Environmentally Sensitive Areas in the vicinity of the RSC Property. patersongroup

52 Mr. Simon Taggart Page 6 File: PE2905-MEMO.01 CSM Section 43.1 of the Regulation does not apply to the subject site in that the subject site is not a Shallow Soil Property, the original depth of soil at the property having been more than 2 m over the majority of the site. Furthermore, the subject site is not within 30 m of a water body. Fill Placement Fill material was identified on the subject site during the previous subsurface investigations by Paterson and Pinchin. The fill material was tested and was found to be in compliance with the selected MOECC standards. No further information is available regarding the fill material. It is interpreted to have been placed concurrently with site development, or at the time of the decommissioning of the retail fuel outlet. Proposed Buildings and Other Structures It is our understanding that the RSC Property is to be redeveloped with a seven-storey mixed use commercial and residential building with up to two (2) levels of underground parking. The existing institutional building will be incorporated into the development. No further information is currently available. Existing Buildings and Structures A three-storey institutional building with one basement level is currently present on-site and will be incorporated into the proposed development. The building consists of a former Salvation Army orphanage and was most recently occupied by a community resource centre. No other existing buildings or structures are to be retained on-site. No environmental concerns were identified with respect to buildings or structures on the subject site. Water Bodies There are no water bodies on the subject site or within the Phase I study area. The closest water body is the Ottawa River, located approximately 1 km to the west of the RSC Property at its closest point. Areas of Natural Significance No areas of natural significance are present on the RSC Property or within the Phase I- ESA study area. patersongroup

53 Mr. Simon Taggart Page 7 File: PE2905-MEMO.01 CSM Environmental Condition Based on the findings of the Phase I ESA and Phase II ESA by Pinchin and the Phase I ESA and Phase II ESA by Paterson completed prior to the commencement of the redevelopment of the site, all soil and groundwater on the subject site were considered to be in compliance with the applicable MOECC Table 3 standards. Analytical test results for soil and groundwater prior to site redevelopment are presented on Drawing PE2905-1R. It is noted that although a groundwater monitoring well was installed and a groundwater sample was obtained as a component of the Paterson Phase II ESA, groundwater triangulation was not achieved. Consequently, during the site redevelopment process, Paterson supervised the completion of a supplemental Phase II ESA at the subject site, which involved the drilling of four (4) monitoring wells into the bedrock in the vicinity of the former retail fuel outlet on the subject site. All groundwater samples were in compliance with MOECC Table 3 standards. Furthermore, no visual or olfactory evidence of soil contamination was observed during the excavation of soil and rock from the subject site for development/grading purposes.
