17 Qualified Person s Statements and Certifications As the qualified person, I certify that: A phase one environmental site assessment of the RSC property, which includes the evaluation of the information gathered from a records review, site reconnaissance, interviews, a report and any updates required, has been conducted in accordance with the regulation by or under the supervision of a qualified person as required by the regulation. A phase two environmental site assessment of the RSC property, which includes the evaluation of the information gathered from planning and conducting a site investigation, a report, and any updates required, has been conducted in accordance with the regulation by or under the supervision of a qualified person as required by the regulation. The information represents the site conditions at the sampling points at the time of sampling only and the conditions between and beyond the sampling points may vary. As of 2014/06/06, in my opinion, based on the phase one environmental site assessment and the phase two environmental site assessment, and any confirmatory sampling, there is no evidence of any contaminants in the soil, ground water or sediment on, in or under the RSC property that would interfere with the type of property use to which the RSC property will be put, as specified in the RSC. Ground water sampling has been conducted in accordance with the regulation by or under the supervision of a qualified person as required by the regulation. I have, within the six months immediately before the submission of this record of site condition, given written notice of intention to apply non-potable ground water site condition standards to the clerk of the local municipality in which the property is located and the clerk of any upper-tier municipality in which the property is located. As of 2014/06/06, in my opinion, based on the phase one and phase two environmental site assessments and any confirmatory sampling, the RSC property meets the applicable full depth generic site condition standards prescribed by section 37 of the regulation for all contaminants prescribed by the regulation in relation to the type of property use for which this RSC is filed, except for those contaminants (if any) specified in this RSC at Table 2, Maximum Contaminant Concentrations Compared to Standards Specified in a Risk Assessment. As of 2014/06/06, the maximum known concentration of each contaminant in soil, sediment and ground water at the RSC property for which sampling and analysis has been performed is specified in this RSC at Table 1, Maximum Contaminant Concentrations Compared to Applicable Site Condition Standards. I am a qualified person and have the qualifications required by section 5 of the regulation. I have in place an insurance policy that satisfies the requirements of section 7 of the regulation. I acknowledge that the RSC will be submitted for filing in the Environmental Site Registry, that records of site condition that are filed in the Registry are available for examination by the public and that the Registry contains a notice advising users of the Registry who have dealings with any property to consider conducting their own due diligence with respect to the environmental condition of the property, in addition to reviewing information in the Registry. The opinions expressed in this RSC are engineering or scientific opinions made in accordance with generally accepted principles and practices as recognized by members of the environmental engineering or science profession or discipline practising at the same time and in the same or similar location. I do not hold and have not held and my employer CCI GROUP INC. does not hold and has not held a direct or indirect interest in the RSC property or any property which includes the RSC property and was the subject of a phase one or two environmental site assessment or risk assessment upon which this record of site condition is based To the best of my knowledge, the certifications and statements in this part of the RSC are true as of 2014/06/06. 34 Phase Two Conceptual Site Model 230 & 240 Dew Street, King City, ON 1.1 Site Description The Site (Phase Two RSC Property) is located approximately 35 m west of the northwest corner of the Dew Street and King Boulevard, in the Township of King, Ontario. The Site measures 0.76 hectares (approximately 1.88 acres) and was used for mixed residential and commercial purposes. The Site buildings were demolished prior to the completion of the Phase One or Phase Two ESA, including the removal of all building foundations, and the Site was proposed for future residential developments. 1.2 Background The need for the Phase Two ESA was identified in the CCIG Phase One ESA completed for the Site in December The Phase One ESA identified the following APECs during the completion of the Phase One ESA. Conversations held with a previous tenant at the Site did not identify any significant spills. As discussed in the Phase One ESA report, an occurrence report was provided to CCIG as part of a regulatory request, which identified that fill material was illegally dumped at the Site. Discussions held with York Region personnel identified that the material has been removed from the Site. However, residual fill material of unknown quality may have remained at the Site which could impact shallow surface soils. 1

35 Phase Two Conceptual Site Model 230 & 240 Dew Street, King City, ON In order to investigate the APECs identified, two (2) Phase Two ESA investigations consisting of drilling, soil and groundwater sampling and chemical analyses were conducted at the Site. The initial Phase Two ESA was conducted by CCIG in April, 2013 (Refer to CCIG s Phase Two ESA report, dated April 15, 2013). The second Phase Two ESA was conducted to satisfy the requirements of Ontario Regulation 153/04, as amended. 1.3 Scope of Work In order to investigate the APECs identified, two (2) Phase Two ESA investigations, consisting of drilling, soil and groundwater sampling and chemical analyses were conducted at the Site. The initial Phase Two ESA was conducted by CCIG in April, 2013 in accordance with the Canadian Standard Association (CSA) Standard Z (Refer to CCIG s Phase Two ESA report, dated April 15, 2013). The second Phase Two ESA was conducted to satisfy the requirements of Ontario Regulation 153/04, as amended. CCIG supervised the drilling and monitoring well installation conducted by Strong Soil Search and Profile Drilling Ltd., between April 8th & July 10th, Ten (10) boreholes (BHs) were advanced at the Phase II RSC Property to depths ranging from 3 meters below grade (mbg) to 5 mbg, while two (2) additional boreholes were advanced at 250 Dew Street. On May 22, 2014, an addition nine (9) boreholes were drilled at the Site by Pontil Drilling, to depths ranging from 1.5 mbg to 8.2 mbg. Four (4) of these boreholes were developed into groundwater monitoring wells. Two (2) additional boreholes were advanced on June 6, 2014 to 0.61 mbg to obtain average concentrations of metal parameters in the vicinity of BH306. It should be noted that originally, the client intended to file one RSC for both properties at Dew Street and 250 Dew Street; however, the Regional Municipality of York later objected to the use of Table 3 Standards for 250 Dew Street. As the Phase Two ESA was conducted before receiving the Region s objection, the Phase Two ESA included both the Phase Two RSC Property as well as 250 Dew Street. The boreholes advanced at 250 Dew Street were only to provide site coverage and were not intended to address any APECs. For assessment purposes, CCIG selected the Ministry of Environment (MOE) 2011 Table 3 Site Condition Standards (SCS) for Residential/Parkland/Institutional (RPI) Property Use in a nonpotable groundwater situation with medium/fine textured soil for 230 and 240 Dew Street. The Phase Two RSC Property is not environmentally sensitive as per the criteria in Section 41 of O.Reg. 153/04: the Site is not located within an area of natural significance, it is not adjacent to or within 30 m of an area of natural significance, and ph test results indicate values which fall within the range of 5 9 for surface soils, and 5 11 for subsurface soils. Based on The Oak Ridges Moraine (ORM) mapping and the information provided by The Regional Municipality of York, the Site is not located within 30 metres of a natural core area or natural linkage area of the 2

Correspondence with the Regional Municipality of York identified that the north portion of the east adjacent property, 250 Dew Street, is located in a Highly Vulnerable Area (HVA) of the ORM. Additionally, the northwest portion of the west adjacent property (230A Dew Street) is located in a Wellhead Protection Area (WPA). However, it should be noted that a HVA or a WPA are not considered Areas of Natural Significance, as defined in Subsection 1 (1) of O.Reg. 153/04 (as amended). The Phase Two RSC Property is not subject to Section 43.1 of O.Reg. 153/04: borehole investigations identified that the Site is not in an area of shallow soil (depth to bedrock based on available topographic maps is approximately 250 mbg), the Site does not include all or part of a water body, and it is not adjacent to a water body or include land located within 30 m of a water body. 1.4 Results In general, the soil profile comprised of fill material underlain by sandy silt to silt till to the explored depths of the boreholes. Bedrock was not encountered in any of the boreholes during drilling; however, based on available topographic and bedrock geology maps, depth to bedrock is expected to be approximately 250 mbg. Monitoring wells were installed during this Phase Two ESA in the unconfined aquifer at the Site. The measured depths to the groundwater table ranged from 3.50 to 3.75 mbg. No free product or oily sheen was observed in any of the monitoring wells with exception of BH1(MW) located at northwest corner of the former private automotive garage building. Petroleum hydrocarbon free product and strong odor was observed during purging and groundwater sampling. Based on the groundwater elevation contours, we have interpreted the direction of the groundwater flow to be in a north to north-easterly direction. The horizontal hydraulic gradient was calculated based on two sets of monitoring wells and ranged from m/m [BH101(MW) to BH103(MW)] and m/m [BH2(MW) to BH4(MW)] in north-easterly direction, with an average horizontal hydraulic gradient of m/m. The vertical hydraulic gradient in the vicinity of the former private automotive garage building was calculated between the deeper aquifer monitoring well BH301(MW) and the remaining monitoring wells. Based on June 2014 groundwater elevation measurements, vertical hydraulic gradients were calculated at a minimum value of m/m in a downward direction between BH2(MW) and BH301(MW), at a maximum value of m/m in a downward direction between BH1A(MW) and BH301(MW), and at an average value of m/m in a downward direction. Based on September, 2014 groundwater elevation measurements, vertical hydraulic gradients were calculated at a minimum value of m/m in an upward direction between BH4(MW) and BH301(MW), at a maximum value of m/m in a downward direction 3

37 Phase Two Conceptual Site Model 230 & 240 Dew Street, King City, ON between BH1A(MW) and BH301(MW), and at an average value of m/m in a downward direction. A total of twenty-two (22) soil samples and seventeen (17) groundwater samples including five (3) duplicate samples of each soil and groundwater, were analyzed by AGAT Laboratories Ltd. for the presence of various contaminants of concern (COCs) to investigate soil and groundwater quality impacts related to the aforementioned APECs. These COCs included: PHC F1-F4, benzene, toluene, ethylbenzene, and xylenes (BTEX), VOCs, PAHs, ph, metals, and inorganics. An additional seventeen (17) soil and six (6) groundwater samples, including three (3) duplicate samples of soil and one (1) duplicate sample of groundwater, were analyzed by Exova. The results of chemical analyses identified the following parameters in soil and groundwater exceeding the MOE Table 3 SCS, from boreholes located at the northern portion of 230 Dew Street. Cadmium and lead (surface soils): BH104 S1 ( mbg) and BH201 S1 ( mbg). PHC F2 and F3 (groundwater): monitoring well BH1 (MW). No other exceedences of the MOE Table 3 SCS at 230 and 240 Dew Street were identified in the remaining soil and or groundwater samples. PHC contamination can be attributed to the former garage building located on the Site. Cadmium exceedences can possibly be attributed to the use of phosphate fertilizers on the Site, which can lead to elevated cadmium levels in soil. Lead contamination may be attributed to lead-based paint chips mixed with the soil. Based on the results of the subsurface investigation, significant migration of contaminated soil or groundwater has not occurred. Samples collected from boreholes advanced downgradient from the contaminated areas showed no exceedences of the Table 3 SCS. Climatic and meteorological effects on the Site may lead to seasonal fluctuations in groundwater elevations. Quarterly sampling events completed post-remediation (June 2014 and September 2014) show that groundwater elevations in all monitoring wells were higher in September, but that groundwater flow direction generally was unaffected. Based on the results of the Phase Two ESA investigations conducted at the Site, the soil and groundwater has impacts above the 2011 MOE Table 3 SCS at the northern portion of 230 Dew Street. Remediation of subsurface impacts is detailed in the Remediation Report, included in Phase Two ESA Report. 1.5 Contaminant Fate and Transport 4

38 Phase Two Conceptual Site Model 230 & 240 Dew Street, King City, ON The chemical constituents identified in the shallow soil at the Site comprise metals (lead and cadmium). The relevant transport mechanisms for the COCs in soil are via leaching and mixing with groundwater chemical constituents by advection, mechanical dispersion and molecular diffusion along groundwater flow paths. The transport of these solutes in groundwater will be retarded by sorption and ion exchange mechanisms (i.e. metal ions) depending on the surface characteristics of the soil mineral particles and the exchangeable cations present. Depending on the ph of the soil pore water in the unsaturated zone and in the groundwater, as well as the availability of exchangeable ions, metal ions will be removed from solution by exchange reactions at cationic exchange sites on the soil mineral particle surfaces. Metal ions can also be removed from the solution through ionic and non-ionic binding interactions with iron and aluminum oxyhydroxide precipitates. These species can also be immobilized through complex interactions with organic and inorganic ligands/complex agents and precipitate formation. As a result, due to retardation effects by sorption/ion exchange and other mechanisms, the estimated linear groundwater velocity is likely overestimated, and the actual contaminant velocity at the Site is anticipated to be significantly lower. 1.6 Human Health, Ecological Receptors and Exposure Pathways Based on the proposed residential land use of the Phase Two property, the potential on-site human receptors that may be present comprise long-term workers (adult), property visitors (adult, child, and toddler), and construction workers (adult). A construction worker while performing ground intrusive works at the Site could potentially be exposed to the COCs in soil by direct dermal contact, incidental ingestion, and soil particle inhalation. The exposure to longterm workers will be limited as the Site will be developed and covered by asphalt and landscape areas; however, in the absence of soil cover systems, the long term workers could be exposed via the direct contact, incidental ingestion, and the soil particulate inhalation pathways. The relevant human health exposure pathways are illustrated in Figure 10. Based on the future residential land use of the Phase Two property, the potential on-site ecological receptors that may be present comprise terrestrial vegetation, such as trees, shrubs, grass and weeds; soil invertebrates such as earthworms, centipedes, millipedes, and nematodes; terrestrial mammals such as voles, moles, shrews, mice, raccoons, and foxes; and terrestrial birds, such as pigeons, sparrows, robins, and hawks. The potential complete exposure pathways considered for soil invertebrates, terrestrial birds and mammals are via dermal contact, and incidental ingestion. The relevant ecological exposure pathways are illustrated in Figure 10. Both human and ecological exposure pathways will be eliminated following completion of the soil and groundwater remediation program, which will remove all contaminated material from the Site. 5
