3 Terms & Conditions Guhring, Inc. (the Company ) warrants to original equipment manufacturers and to industrial and commercial distributors and users of Guhring, Inc. brand products (the Products ) purchased from the Company that each new Product shall be free from defects in materials and workmanship. The Company s sole obligation under this warranty is limited to furnishing, without additional charge, a replacement for or, at its option, repairing or issuing credit for any Product which shall within one year from the date of sale by the Company be returned freight pre-paid to the warehouse designated by a Company representative and which upon inspection is determined by the Company to be defective in materials or workmanship. Complete information as to operating conditions, machine setup and application of cutting fluid should accompany any returned Product. This warranty shall not apply to any Product which has been subjected to misuse, improper operating conditions, machine setup or application of cutting fluid, or which has been repaired or altered if such repair or alteration in the Company s judgement would adversely affect performance of the Product. THIS WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. The Company s sole liability on any claim of any kind, whether in contract, tort or otherwise, for any loss or damage arising out of, connected with, or resulting from the manufacture, sale, delivery or use of the Product shall in no case exceed the cost of replacement or repair as provided herein. IN NO EVENT SHALL THE COMPANY BE LIABLE FOR ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES. There are no other warranties, expressed or implied, made by the Company to original equipment manufacturers or to industrial or commercial distributors or users except the warranty against defects in material and workmanship set forth above, and the Company neither assumes nor authorizes any person or firm to assume for it any other obligations or liability in connection with its Products. Important Orders Orders entered and in process will not be subject to change by addition or deletion. Guhring will endeavor whenever possible to consolidate shipments on a daily basis. Distributor Minimum Order Minimum order value of US$50 NET shipped to any single location. Orders of less than US$50 NET will be subject to a US$10 non-refundable service charge. Freight F.O.B. Guhring, Inc. Return Goods All returns must be processed through an authorized Guhring distributor. All requests for return goods must be made to Guhring credit managers located at the Guhring distribution center from which the product was purchased. No materials will be accepted without prior agreement and a Return Goods Authorization Number (RGA#). Clear documentation and reason for return must accompany all returns. Sheets detailing return qualifications are available upon request. Only full, unbroken packages will be accepted. Product must be new and unused, freight pre-paid. In all cases, the Guhring Territory Manager must be contacted to discuss return instructions on Special Tools. Standard product stock returns may be made once per year. Returns made without a replacement order are subject to a 30% restocking fee. A restocking charge of 10% applies for returns made with a replacement order of equal value. The restocking fee is waived for returns made with a replacement order of 120% value. All sales are final. Note Every effort has been made to assure the accuracy of the information presented herein.
