ADOPTION OF MINUTES.1 Executive Committee Minutes - April 26, 1999 Moved by Councillor Wiebe, seconded by Councillor Fast, that the minutes of the Executive Committee meeting of Council held April 26, 1999, be adopted. Hall, Director of Fire Rescue Services/Fire Chief - Flood Preparedness The Director of Fire Rescue ServiceslFire Chief outlined current activities taking place with respect to flood preparations in the City of Abbotsford. He indicated that, for Sumas and Matsqui Prairies, there was approximately a 10% chance of worst-case scenario flooding due to 70% higher than normal snow packs in the Lower Fraser, Thompson-Okanagan, and coastal areas. Noting that the potential for flooding was weather dependent, he advised that very extreme weather patterns would be necessary to cause a flood of the magnitude that occurred in 1948, and that there was little chance of catastrophic flooding in areas protected by good dykes, such as those along the Fraser and Vedder Rivers in the City of Abbotsford. The Glen Valley area, which is not protected by dykes, would be vulnerable to flooding if water levels reach 7.5 m. Councillor Warawa left the meeting at 1 :20 p.m. The following was also noted: the Engineering Department is conducting regular dyke patrols; emergency services, such as fire, police, and ambulance, are determining methods to provide emergency response to flooded areas within the City; Provincial initiatives include the establishment of the Provincial Emergency Program Response Centre in Surrey, stockpiling sandbags for the province at Abbotsford Airport, producing resource lists, and determining alternative locations for farm animals should evacuation become necessary; and additional information is available on the City's website, which links directly with the Provincial Emergency Program website. Although residents in high risk areas are being encouraged to find alternative accommodations in the event of a flood, Emergency Social Services will be available. Moved by Councillor Fast, seconded by Councillor Wiebe, that the presentation by the Director of Fire Rescue Services/Fire Chie~, regarding the City's flood preparedness, be received. E CARRIED. Councillor Warawa returned to the meeting at 1 :25 p.m.

Dhaliwal, McKee Road - Zoning and Official Community Plan Amendment Applications ( /R99-6) In Report No. DEV dated April 29, 1999, the Senior Planner reviewed applications for the R. Braich and M. Dhaliwal property at McKee Road, to change the Official Community Plan designation from Low Density Residential to Medium Density Residential and rezone from One Unit Country Residential Zone (RR3) to Multi-unit Residential RM25 Zone (RM25), to permit the development of a 24-unit townhouse site. Prior to development, environmental and form and character development permits would be required in order to ensure that development recognizes the transition from single family to medium density residential use, minimizes potential conflicts between the adjacent future commercial and residential uses, responds sensitively to the McKee Road streets cape, and is appropriately designed relative to the steep slopes. Moved by Councillor Wiebe, seconded by Councillor Gill that, as recommended in Report No. DEV dated April 29, 1999, from the Senior Planner: (1) staff prepare and present amendments for the R. Braich and M. Dhaliwal property at McKee Road to redesignate from Low Density Residential to Medium Density Residential and rezone from One Unit Country Residential Zone (RR3) to Multi-unit Residential RM25 Zone (RM25) when issues of development and funding of items not budgeted for by the City, as listed in the report, have been resolved; and (2) the Mayor and Director of Administration be authorized to execute all documents relating to this m~tter. 4 held May 3, 1999, at 1 :00 p.m. in the Matsgui Centennial Auditorium Page 4.2 Angle Developments Ltd., 1425 Sumas Way - Development Permit Application ( D99-13) Report No. DEV dated April 28, 1999, from the Deputy Approving Officer, reviewed a form and character development permit application and associated variances, to allow for the development of a retail commercial shopping centre on the Angle Developments Ltd. property at 1425 Sumas Way. The eastern portion of the site is located within the Sumas Way Gateway Development Permit Area, which encourages visually attractive multi-family residential, commercial, and industrial development. Variances would include: (a) relaxation of the minimum exterior lot line setback from Building A from 7.5 m to 0 m along the west property boundary and to approximately 2 m along the south boundary; (b) elimination of the required 3 m wide perimeter planting strip along the site's three road frontages; and (c) relaxation of the minimum amount of required interior plantings from one tree for every 10 parking spaces to one tree for every 27 spaces. It was clarified that adequate storm drainage would be required in order to protect the nearby Marshall Creek from run-off from the subject site, and a roadway will be constructed from Barron's Way to the north property line of the property. This road will eventually link to McClary Road, providing a parallel route to Sumas Way from McConnell Road to McClary Road. Moved by Councillor Wiebe, seconded by Councillor Warawa that, as recommended in Report No. DEV dated April 28, 1999, from the Deputy Approving Officer: (1) the form and character development permit, with associated variances listed in the report, for the Angle Developments Ltd. property at 1425 Sumas Way, be approved in principle and a permit be prepared for an upcoming Council hearing; and (2) the Mayor and Director of Administration be authorized to execute all documentation relating to this matter. E CARRIED..3 R. Dyck (Executor for the Estate of G. Van Kampen), 3217 Saddle Street - Rezoning Application ( R97-49) Report No. DEV dated April 29, 1999, from the Senior Planner, presented an application from R. Dyck (Executor for the estate of G. Van Kampen) to rezone property at 3217 Saddle Street from One Unit Suburban Residential Zone (RR4) to One Unit Urban Residential Zone (RS3). The site, which is heavily treed and contains a steep rise and undulating plateau, is designated Low Density Residential in the Official Community Plan, where single detached and semi-detached housing is permitted on individual lots.

5 held May 3, 1999, at 1 :00 p.m. in the Matsgui Centennial Auditorium Page 5 Given the environmental and topographical constraints, it would be difficult to achieve single detached lots on the entire site without compromising the integrity of some features, such as a significant stand of trees and escarpment. The proposal for RS3 zoning is consistent with the Official Community Plan; however, it would necessitate removing or relocating the existing escarpment. Also, the significant earthworks required to create buildable lots would reduce greatly opportunities for preserving trees. S. Dyer, on behalf of the applicant, advised that the type of development proposed for the subject property was in response to current market conditions. Commenting on the site's topographical constraints, he indicated that a horticulturist, retained by the developer, had determined that only a small percentage of healthy trees existed on the site and could be retained. In response to Council concerns regarding the proposal to relocate the existing escarpment, Mr. Dyer advised that the area would be completed revegetated using the City's two to one tree replacement policy and would be used only for passive residential use. All works would be undertaken in accordance with a geotechnical report. Moved by Councillor Warawa, seconded by Councillor Wiebe, that Report No. DEV dated April 29, 1999, be received from the Senior Planner: and (1) staff prepare and present an amendment to Abbotsford Zoning By-law, 1996, to rezone the property at 3217 Saddle Street, submitted by R. Dyck (Executor for the Estate of G. Van Kampen), from One Unit Suburban Residential Zone (RR4) to One Unit Urban Residential Zone (RS3), when issues of development and funding of items not budget by the City, as listed in the report, have been resolved; and (2) the Mayor and Director of Administration be authorized to execute all documents related to this matter. One member of Council, noting the potential for future soil erosion, opposed the regrading of the esccl!pment and removal of a significant amount of trees fro~ the subject site. The motion was then put and Opposed: Councillor Ross E CARRIED.

6 held May 3, 1999, at 1 :00 p.m. in the Matsgui Centennial Auditorium Page 6.4 AGP Inc., 3067 Turner Street - Development Variance Permit Application ( D99-18) Report No. DEV dated April 28, 1999, from the Assistant Planner, discussed a development variance permit application to relax the height restriction in the General Industrial Zone (12) to allow for the construction/modification of a feed manufacturing facility on the AGP Inc. property at 3067 Turner Street. The variance would allow storage bins 20.6 m in height and a distribution auger 38.1 m in height, rather than the 12.2 m permitted under Abbotsford Zoning By-law, ADMINISTRATION Moved by Councillor Wiebe, seconded by Councillor Gill that, as recommended in Report No. DEV dated April 28, 1999, from the Assistant Planner: (1) the development variance permit application, to relax the height restriction in the General Industrial Zone (12), to allow for the construction/modification of a feed manufacturing facility on the AGP Inc. property at 3067 Turner Street, be approved in principle and a permit prepared for an upcoming Council hearing; (2) the applicant be required to enter into a Section 219 Covenant with the City to deal with potential noise emissions; and (3) the Mayor and Director of Administration be authorized to execute all documentation relating to this matter. E CARRIED..1 Public Attendance at Council Meetings ( ) Report No. ADM d~ted April 28, 1999, from the Director of Administr~tion, clarified when the Municipal Act allows the public to be excluded from a Council meeting. The public may only be excluded from a meeting if, in the opinion of Council, the community interest so requires. With the respect to individuals requesting to attend special, or in camera, meetings, Council was advised that it may not selectively include one or more persons at a meeting from which the public is excluded. Moved by Councillor Warawa, seconded by Councillor Ross, that Report No. ADM dated April 28, 1999, be received from the Director of Administration, clarifying when the Municipal Act allows the public to be excluded from a Council meeting.
